Terms and Conditions
The following document details the terms and conditions of Yark Nissan One-to-One Rewards Program.
Upon receipt of the Yark Nissan One-to-One Rewards Program membership cards, member agrees to be bound by the program rules, terms and conditions. Yark Nissan One-to-One Rewards members will receive incentive points every time they 'swipe' their card for every dollar spent on parts and services and up to a specified amount towards the purchase of a new Nissan vehicle at Yark Nissan. These points are only redeemable at Yark Nissan and not at any other Yark Automotive Group franchise or Nissan dealership. This membership is at no cost to the consumer. Simply swipe your card at our cashier when you pick up your vehicle and we'll take care of the rest. With every dollar you spend in our service department, we will apply a percentage of your total bill pre-tax to the preferred card in the form of award points. We are a full-service maintenance and repair center. As an authorized Nissan dealer, our customers are assured of the availability of genuine Nissan parts for all vehicle maintenance and repair needs. We have the right to change the rules and/or terms or cancel the program at any time without notice.
Overview of Rewards Program
The Yark Nissan One-to-One Rewards is a loyalty program sponsored by Yark Nissan, Toledo, Ohio that allows owners to earn incentive points toward future service, parts and accessory purchases. Rewards also extend to the purchase or lease of any future new Nissan vehicle from Yark Nissan up to a maximum of $250 above and beyond any applicable manufacturer rebates. Reward points are not retroactive for any service, parts, accessory or sales purchase for any reason. All redeemable rewards points must be redeemed at the time of sale. Reward points earned may not be used at any other Yark Automotive Group franchise or any other Nissan dealer.
Program Rules
Earning Program Dollars
When you first enroll in the One-to-One Rewards, the member will receive the Yark Nissan One-to-One Rewards card. The card is to be used for each eligible transaction. As of November 5, 2010, incentive Points can be earned in the following manner:
Member's points standings can be checked at any Yark Nissan scan terminal or online @ www.nissanonetoonerewards.com
Transactions credits will be posted within 30 days of the qualified transaction date.
Participation in the Program
One-to-One Rewards is available to all Yark Nissan customers who are over the age of 18. Fleet or wholesale customers are not eligible to participate in the program.
Participation in the program constitutes each One-to-One Reward owner's full and unconditional agreement to these Terms and Conditions.
The personal information that is collected from each customer in conjunction with the program will be used in accordance with the Yark Automotive Group Privacy Policy.
General Terms and Conditions
Yark Nissan may modify any of the terms and conditions governing the Program-- including but not limited to, the methods through which incentive points can be earned, how the Program can be used, the value of the earned points, at any time, without notice, even though these changes may affect the Reward Owner's ability to use the points that have already been earned.
The Program has no pre-determined termination date and may continue until such time that Yark Nissan terminates the program. The program may be terminated without notice. Accrued One-to-One Program Points do not constitute property of a One-to-One Rewards Owner and have no value outside of the Program. Program member points have no cash value and may be revoked at any time as set forth herein. Reward points may not be exchanged for cash, assigned, bartered or transferred except as a matter or otherwise operation by law. Each One-to-One Program Member is responsible for ensuring that the information in his/her account in accurate and kept current.
Abuse of the One-to-One Rewards Program (including failure to follow program policies and procedures, the sale or barter of awards and any misrepresentation of fact relation thereto or other improper conduct, as determined by the Dealer in its sole judgment, any untoward or harassing behavior with reference to any Dealer employee or any refusal to honor Dealer employee's instructions) may result in cancellation of the member's account and future disqualification from program participation, forfeiture of all points accrued. Dealer reserves the right to take appropriate legal action, as it deems necessary and to recover damages, attorney's fees and court costs.
Limitation of liability governs that each Program member accepts all responsibility for and hereby indemnifies and holds harmless Yark Nissan and each of their related companies (Nissan) and respective officers, directors, employees shareholders, agents and successors and assigns the released parties from and against any claims that may arise from actions taken by such member or for any unauthorized access to One-to-One Preferred Program account from a third party. Under no circumstances, including but not limited to negligence, shall the released parties be liable for any direct, indirect, incidental, special or consequential damages arising out of the program. By participating in the One-to-One Program, a One-to-One Rewards Member waives any and all rights to bring any claim or action related to such matters in any forum.
We will make our best efforts that posted prices are always accurate however, we are not responsible for any typographical or other errors that may appear on the site. If the posted price for a vehicle or service is incorrect due to a typographical or other error, such as data transmission, etc., this Dealership or Pixel Motion, Inc. are only responsible for the correct price, which will be provided as soon as we are made aware of such error(s). Ultimately, it is your responsibility to ensure that the information is 100% accurate with the Dealer.
Posted vehicle images and descriptions on our website is representative to what is provided by our suppliers. Please note that the actual vehicle may slightly differ from its specifications and/or images. The Dealership is not responsible for any typographical, pricing, product specifications, advertising or shipping errors. Advertised prices and availability are subject to change without notice.
In the event a vehicle is posted at an incorrect price due to these errors, or if an error in pricing was received from our suppliers, the Dealership reserves the right to refuse and/or cancel these orders.
